Consumer Legislation

17. Our Site and our products are intended to be used by our Customers, Traders and Retailers for business purposes. As such we are regulated by the Australian Competition and Consumer Commission (ACCC), which is an independent statutory authority. Formed in 1995, the ACCC administers the Trade Practices Act 1974 and consumer legislation.

Disputes

18. Any disputes arising as a result of the Site will initially be dealt with through mediation.
19. Nothing prevents any party from approaching the Courts of Australia for injunctive relief.

Jurisdiction

19. These Terms and Conditions will be governed by, and construed in accordance with, the laws of the State of Victoria, Australia.
20. You irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia with respect to any legal action, suit or proceeding or any other matter arising out of or in connection with these Terms and Conditions.
21. You irrevocably waive any objection you may now or in the future have to the venue of any proceedings, and any claim you may now or in the future have that any proceedings have been brought in an inconvenient forum, where that venue falls within Clause 20.

Termination

    1. If a serious complaint or multiple complaints are received about the User;
    2. If the User breaches these Terms and Conditions;
    3. If we, at our sole discretion, deem the User’s behaviour to be unacceptable.

General

28. These Terms and Conditions constitute the entire understanding and agreement between you and us and supersede any and all prior oral and written communications on the subject matter contained in them.
29. If any provision in these Terms and Conditions is held invalid, then such provision (to the extent that it is invalid) is deemed severed from these Terms and Conditions and the remainder shall not be affected.
